Dear Planning Inspectorate This brief note, together with our letter dated 15th March 2022 sent by email under separate cover, are together the Section 56 Relevant Representation made on behalf of HPUT A Limited and HPUT B Limited as trustees of the Federated Hermes Property Unit Trust (“Federated Hermes”), for whom we act, in relation to Sunnica Energy Farm (the “DCO Scheme”). Federated Hermes OBJECTS to the DCO Scheme. Federated Hermes owns the “LGC Campus” comprising the freehold of the land and buildings lying to the east of Newmarket Road, Snailwell, Newmarket. The LGC Campus is home to one of the largest bioanalytical centres in the world spread over 8,000m2 with over 380 scientists on site and is in the process of delivering a substantial expansion on the site for further such activities. Sunnica’s application for the DCO Scheme does not provide adequate information to understand properly its impacts on the LGC Campus and its expansion, but on any analysis these are clearly likely to be severe. This is on the basis of the wide-ranging, unlimited and effectively indefinite rights to use substantial and key parts of the LGC Campus during construction and carry out permanent works over that land. Detail and illustrative figures to assist the Planning Inspectorate in seeking to understanding the extent of the impact of the DCO Scheme on this sensitive receptor are more particularly set out in our letter of 15th March 2022, which we understand will be published alongside this brief note. It would have been preferable for Sunnica, whom we have so urged, to have frontloaded exploring and documenting with Federated Hermes how the DCO Scheme could interact with a site as complex and sensitive as the LGC Campus long before making its DCO application. Federated Hermes may therefore withdraw its objection subject to appropriate mitigation being secured both by protective provisions on the face of any development consent order for the DCO Scheme and by way of an option and impact mitigation deed between Federated Hermes and Sunnica. Sunnica is urged to commence meaningful engagement towards such protective provisions and deed with Federated Hermes as a matter of urgency. Yours faithfully Bryan Cave Leighton Paisner LLP
