Following the High Court’s Order dated 8 July 2021 quashing the decision to grant development consent for the A38 Derby Junctions scheme, the Secretary of State has issued his Statement of Matters (PDF, 154KB) and invites the Applicant to make further representations for the purposes of the re-determination of the application by 23:59 on 31 August 2021.

Following this, the Secretary of State then invites Interested Parties to submit further representations on the Applicant’s response and on all other matters in this Statement of Matters. The deadline for any such response is 23:59 on 26 October 2021.

8 July 2021

Following an Order of the High Court issued on 8 July 2021, the decision of the Secretary of State dated 8 January 2021 to grant the application by Highways England for development consent for the proposed A38 Derby Junctions has been quashed. The Secretary of State will now re-determine that application. Further details on the re-determination process will be published here in due course.

Notifications of a new deadline for completion of examination and of a variation to the Examination Timetable have been published.
On 27 March 2020 the Secretary of State set a new deadline for completion of the examination on or before 8 September 2020. A statement about the extension will be made to Parliament as soon as possible after it is sitting again.
Further to the Secretary of State’s decision, the Examining Authority has decided to extend the examination beyond 8 April 2020, to the minimum necessary for the examination of remaining issues and for matters of fairness to be addressed. The Examining Authority will issue an update to the Examination Timetable as soon as is practicable, together with information on any new arrangements that will be required to assist in completing the examination.
