On 24 June 2024 he Secretary of State issued a letter inviting relevant local authorities to comment on the request dated 27 March 2024 from Medworth CHP Limited to correct errors in Medworth Energy from Waste CHP Order 2024 (SI 2024 No. 230). The deadline for comments is 23:59 on 30 July 2024. Comments should be submitted by email to medworth@planninginspectorate.gov.uk.

Section 118 of the Planning Act 2008 sets out the period within which proceedings may be brought by way of judicial review questioning an order granting development consent. The time period is established by reference to the date of publication of the development consent order or, if later, the statement of reasons. The Department for Energy Security and Net Zero considers that the date of publication for the purposes of section 118 is 20 February 2024, and the period during which judicial review proceedings may be brought should be calculated on this basis. The question of whether any judicial review proceedings have been brought within the relevant statutory time period is a matter for the Court.
