11 March 2024

Section 118 of the Planning Act 2008 sets out the period within which proceedings may be brought by way of judicial review questioning an order granting development consent. The time period is established by reference to the date of publication of the development consent order or, if later, the statement of reasons. The Department for Energy Security and Net Zero considers that the date of publication for the purposes of section 118 is 20 February 2024, and the period during which judicial review proceedings may be brought should be calculated on this basis. The question of whether any judicial review proceedings have been brought within the relevant statutory time period is a matter for the Court.

Following publication of the announcement and documents relating to the Medworth Energy from Waste Facility DCO, clarification was required. Whilst that clarification process took place, information relating to the decision was removed from the website. The announcement and relevant documentation have now been reinstated, with no alterations having been made.

The Applicant has informed the Planning Inspectorate that a person with a legal interest in the land affected by the Proposed Development was not notified of the accepted application and was therefore not made aware of the period within which they could make a Relevant Representation.
