Mr Hulse called requesting information on why Hoar Cross Parish Council have been consulted upon regarding the proposed Gas transporter pipe line at Willington. He also requested a map to be sent to him that has been used by the IPC to identify the Parish Council as a relevant local authority.
Advice given
Dear Mr Hulse,
Thank you for your query relating to Hoar cross Parish Council and how it is affected by the proposed Willington Gas Transporter Pipe -line.
As discussed in our earlier telephone conversation, Section 43 of The Planning Act 2008 ("the Act") outlines local authorities that are to be consulted in relation to a proposed development.
Hoar cross Parish Council has been identified as an "A" authority. The proposed development does not fall within the parish itself, but as per section 43, there is a statutory role to consult Local Authorities where the project is proposed or neighbouring authorities:
(2) A local authority ("A") is within this section if - (a) the land is in the area of another local authority ("B"), and (b) any part of the boundary of A's area is also part of the boundary of B's area.
Unfortunately, the reference map used to determine this is not available for public release by the IPC; however, the promoter's website (RWE npower) do have a project details document which will provide you with suitable geographical assistance:
