Malthurst South East Limited (MSEL) is part of Motor Fuel Group and is the owner and operator of Cobham Services petrol filling station (PFS). MSEL is the owner and occupier of plots 06-175 and 06-196 referred to in the Book of Reference [AS-042] and shown on the Land Plans [APP-007]. The Applicant is seeking to acquire the freehold of MSEL’s land which will result in the closure of the PFS. As set out in Annex B to the Statement of Reasons [AS-040], MSEL and the Applicant have been in discussions regarding the timing of the transfer of the PFS land to the Applicant, decommissioning of the PFS and relocation of the PFS business to another site. Heads of Terms have been agreed and a cooperation agreement is currently under negotiation. MSEL is hopeful that agreement with the Applicant can be reached soon. However, in the event that agreement has not been reached by the beginning of the Examination, MSEL will submit more detailed representations as part of its Written Representation.
