The Able Marine Energy Park development consent order is made in the form of a statutory instrument and needs to go through Parliamentary processes before coming into effect. This is because the Order contains a certain type of legislative provision; it applies statutory powers to compulsorily acquire land of statutory undertakers, who have sustained their objection to those powers.
