Are you able to give me an indication of timescales on the current review please, and which Advice Notes are being reviewed please?

Alternatively please could you put me in touch with someone who could give me an indication please.

Advice given

You are correct in your understanding that some of The Planning Inspectorate’s advice notes relating to the Planning Act 2008 regime are in the process of being reviewed.

The advice notes for which updates are prioritised to reflect both changes to the statute and acquired knowledge are as follows:

• Advice note 3: EIA consultation and notification; • Advice note 4: Section 52 - Obtaining information about interests in land; • Advice note 5: Section 53 - Rights of entry; • Advice note 7: Environmental Impact Assessment, screening and scoping; • Advice note 9: Rochdale Envelope; • Advice note 10: Habitat Regulations Assessment relevant to nationally significant infrastructure projects; • Advice note 11: Working with public bodies in the infrastructure planning process (specifically the addition of Welsh language versions of annexes A to F); • Advice note 12: Development with significant transboundary impacts consultation; and • Advice note 15: Advice digest.

It is anticipated that many of the updated versions will be published by the beginning of July.

I would also draw your attention to the intention for two ‘best practice notes’ to be compiled in collaboration with the National Infrastructure Planning Association (NIPA) and the Local Government Association (LGA). These however are unlikely to emerge until later in the year.
