Simon Mitchell from OFCOM queried why OFCOM have received the Rules 6 & 9 letters recently issued by the IPC. The query suggested confirmation of the bodies status under the Planning Act 2008.

Advice given

Dear Simon,

Thank you for your email dated 7 November 2011 in regard to the Ipswich Rail Chord proposal by Netwrok Rail.

The developer - Network Rail has identified OFCOM as an "affected person" as per Section 92(5) of the Planning Act 2008 ("the Act"). This subsequently means that OFCOM are considered an "Interested Party" under Section 102 (1) (a) of the Act.

The IPC have a duty to inform all Interested Parties of any procedural decsions, like the one you have recently received which is in respect of Rules 6 and 9 of the The Infrastructure Planning (Examination Procedure) Rules 2010: "Notice of preliminary and other meetings" and "Notice of procedural decsions".
